La Costituzione e le sue modificazioni (1948-2025)

ABSTRACT (IN ITALIANO): Il contributo ricostruisce le modificazioni della Costituzione repubblicana dal 1948 al 2025, distinguendo tra revisioni approvate e proposte e individuando le principali fasi del riformismo costituzionale italiano. Attraverso una ricognizione quantitativa delle venti leggi di revisione e dei 2.701 progetti presentati alle Camere, mostra come le modifiche abbiano inciso soprattutto sulla seconda parte della Costituzione, con particolare riguardo al Parlamento e al titolo V, mentre le questioni del bicameralismo paritario e della forma di governo restano sostanzialmente irrisolte. L’analisi evidenzia il passaggio dai tentativi organici di riforma, culminati nei fallimenti referendari del 2006 e del 2016, a un riformismo puntuale e frammentario. La XIX legislatura conferma tale tendenza, pur affrontando temi di grande rilievo, quali il premierato, la separazione delle carriere e lo status di Roma Capitale. Il bilancio conclusivo è quello di una Costituzione ampiamente modificata ai margini, ma ancora difficilmente riformabile nei nodi istituzionali più rilevanti.
ABSTRACT (IN INGLESE): The article reconstructs the amendments to the Italian Republican Constitution from 1948 to 2025, distinguishing between enacted revisions and reform proposals and identifying the main phases of Italian constitutional reform. Drawing on a quantitative review of the twenty constitutional revision laws and the 2,701 bills submitted to Parliament, it shows that changes have mainly affected the second part of the Constitution, especially Parliament and Title V, while the questions of symmetric bicameralism and the form of government remain substantially unresolved. The analysis highlights the transition from broad reform projects, culminating in the failed referendums of 2006 and 2016, to a piecemeal and fragmented reform strategy. The nineteenth parliamentary term confirms this trend, while addressing major issues such as the premiership reform, the separation of judicial careers and the special status of Rome as the capital city. The concluding assessment is that the Constitution has been extensively amended at its margins yet remains difficult to reform where the most important institutional issues are concerned.
