Leggi elettorali: il Rosatellum e i motivi che ne rendono necessaria la revisione

ABSTRACT (IN ITALIANO): Il contributo ricostruisce la struttura, il funzionamento e le principali criticità costituzionali della legge n. 165 del 2017 (Rosatellum). Dopo aver esaminato la compenetrazione tra quota maggioritaria e proporzionale, il voto congiunto, le soglie di sbarramento e il trasferimento dei voti, l’analisi si concentra sui meccanismi «a cascata» di assegnazione dei seggi, sulle liste bloccate, sulle pluricandidature e sugli slittamenti territoriali. Una sezione specifica riguarda l’elezione del Senato e i problemi derivanti dall’interazione tra soglie nazionali e riparto regionale. Nelle conclusioni, il lavoro valuta la proposta A.C. 2822, rilevando che essa non supera le criticità del Rosatellum e ne aggiunge ulteriori, in particolare per il premio di maggioranza, la libertà di scelta degli elettori, la base regionale del Senato e il rischio di maggioranze divergenti nelle due Camere.

 

ABSTRACT (IN INGLESE): This article reconstructs the structure, operation and main constitutional weaknesses of Law No. 165 of 2017, commonly known as the Rosatellum. It examines the interaction between the majoritarian and proportional components, the single-vote mechanism, electoral thresholds and vote transfers, before focusing on the multi-level allocation of seats, closed lists, multiple candidacies and the territorial displacement of seats. A separate section addresses the election of the Senate and the tensions arising from the combination of national thresholds and regional seat allocation. The concluding section assesses Bill A.C. 2822, arguing that it does not remedy the defects of the current system and introduces further concerns regarding the majority bonus, voters’ freedom of choice, the Senate’s regional basis and the possibility of divergent majorities in the two Houses.
